The limitations set forth in this section shall apply regardless of the theory of liability (whether in contract, tort, negligence, strict liability, or otherwise) and even if Imos Pizza has been advised of the possibility of such damages.

Certain states, including New Jersey, do not allow limitations on implied warranties or exclusions of consequential damages. If applicable law in your jurisdiction does not permit these limitations, they may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Imos Pizza and its officers, directors, shareholders, employees, contractors, agents, licensors, and suppliers (collectively, "Indemnified Parties") from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

14.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRE ARBITRATION PROVISION OF THESE TERMS SHALL BE NULL AND VOID.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, confidentiality obligations, or other proprietary rights.

15. Term and Termination
